How long is the promotion available?
The promotion is valid from 17th October 2016 to 31st January 2017.
Who is eligible for this promotion?
The Promotion is offered to redONE’s postpaid customers who are making payments of their postpaid bills using the FPX payment option via redONE Selfcare portal. Only FPX users who are eighteen (18) years of age and above and have a valid identification document (example: identity card or passport) are eligible to participate in the Promotion.
I am a redONE customer. Am I eligible for this draw?
You are eligible for this draw if you make a minimum payment of RM30 in a single bill using FPX via redONE’s Selfcare portal. Every RM30 payment is eligible as one (1) draw.
How do I know if I qualified for the draw?
You will automatically qualify for the draw once you make a minimum payment of RM30 in a single bill using FPX via redONE’s Selfcare portal between 17 October 2016 to 31 January 2017.
How will I know if I am selected from the Lucky Draw?
You will be contacted by telephone and will be required to answer questions as determined by the Organisers. You must answer all questions correctly to win the Prize.
What if I answer the question(s)incorrectly or cannot be contacted?
If you fail to answer all the questions correctly or cannot be contacted, the Organisers reserve the rights to allocate the prize(s) to the next Selected Participant, chosen from the next random draw, and declare the Said Participant as the winner.
I am a winner. When will I get my prize?
You will be contacted and notified by the Organisers by email and telephone call based on the information provided by the respective financial institutions within thirty (30) days after the Promotion ends. You must respond to the Organisers’ agreement to accept the prize(s) within seven (7) days of receiving the email notification or telephone call.
What if the prize is faulty? Can it be exchanged or replaced?

Are the prizes transferable?
All prizes are not transferable.

Pay your postpaid bills via redONE’s Selfcare portal using FPX and stand a chance to win a smartphone! (“Promotion”)

Organiser
1) The Promotion is organised by Malaysian Electronic Clearing Corporation Sdn. Bhd.(Company No.836743-D) (“MyClear”) and Red One Network Sdn Bhd (Company No. 619094-D) (“redONE”) (collectively referred to as “Organisers”).
 

Eligibility

1) This Promotion is offered to redONE’s postpaid customers who are making payments of their postpaid bills using FPX payment channel/method (“the Customers”). Only Customers who are eighteen (18) years of age and above and have a valid identification document (example: identity card or passport) are eligible to participate in the Promotion (“Participant”).
2) A Participant must also have an active Internet banking account with any of FPX participating banks during the Promotion Period and until redemption of the Promotion Prizes.
3)  Directors, officers, employees of the Organisers (including its associated companies) and their immediate family members (spouse, children, parents siblings) and/or representatives, employees, servants and/or agents of advertising and/or public relations agencies of the Organisers and their immediate families are not eligible to participate in the Promotion.
 

Promotion Period

4) The Promotion Period is from 00:00 hours (GMT+8) on 17/10/2016 until 23:59 (GMT+8) hours 31/01/2017 (both dates inclusive).
5) The Organisers reserve the right to amend the Promotion Period at any time. The Organisers also reserve the right to cancel, terminate or suspend the Promotion for any reasons without any prior notice. The cancellation, termination or suspension of the Promotion shall not entitle the Participants to any claim or compensation against the Organisers for any loss or damage suffered caused by such cancellation, termination or suspension.

Qualifying Criteria

Both parties have agreed to run the following programs for the purpose of the said promotion:

 

Lucky Draw

A lucky draw for redONE’s postpaid customers which subjected to terms and conditions as set out herein. The Promotion is divided into 2 mechanism:
i) Minimum payment of RM30 and above per bill (1st Promotion); and
ii) Bill payment of any amount via FPX for 3 continuous months (2nd Promotion). 

  Promotion 1:

A payment made by the Participant for the postpaid bills with a minimum amount of Ringgit Malaysia Thirty (RM 30.00) only in a single bill using FPX via redONE’s “Selfcare portal” is eligible as one (1) entry. There is no limit to the number of eligible entries by the Participants during the Promotion Period.

  Promotion 2:
8)

A payment made by the Participant for the postpaid bills with any amount for 3 continuous months using FPX via redONE’s “Selfcare portal” is eligible as one (1) entry.

9)

For both Promotion 1 and Promotion 2 above, the payment must be made during the Promotion Period and comply with the eligibility and qualifying criteria mentioned herein, in order to be considered as eligible entries. Any payment made outside the Promotion Period will be disqualified.

 

Entry Eligibility

10) Each Postpaid Bill Payment performed by a Participant at redONE’s Selfcare portal using FPX shall automatically be eligible as one (1) draw (“Eligible Draw”).
11) The Postpaid Bill Payment(s) must be performed using FPX during the Promotion Period and comply with the eligibility and qualifying criteria mentioned herein, in order to be considered as Eligible Draw(s).
12) There is no limit to the number of Eligible Draw(s) entered by a Participant but Postpaid Bill Payment performed outside the Promotion Period will not be entitled for the draw. Postpaid Bill Payment made using payment channels other than FPX shall not be entitled for the draw.
13) Any Participant who violate the terms and conditions herein, tamper with the operation of the Promotion, perpetrate fraud or abuse, or engage in any conduct that is deemed detrimental or unfair to the Organisers, the Promotion or any other Participant (in each case determined at the Organisers’ sole discretion) are subject to disqualification from entry or participation in the Promotion. The Organisers reserve the right to disqualify Participant(s) whose eligibility is in question or who is otherwise ineligible to participate in the Promotion or enter into the Promotion, and to have any declared Prize(s) for such Participant(s) be forfeited with.
 

Shortlisting Winners and Announcement

14) An Eligible Participant will be chosen from a random draw (“Selected Participant”) from the pool of Eligible Entries collected until the end of the Promotion Period. The draw will be performed by a random computer process on the monthly basis. The draw will be performed by a random computer process from the pool of eligible entries on monthly basis based on the date of draw for each Promotion 1 and Promotion 2.
15) The Selected Participant will be contacted by telephone and required to answer questions as determined by the Organisers. The Selected Participant must answer all questions correctly to win the Prize. These processes described herein will apply to determine all forty eight (48) winners in both Promotion.
16) In the event the Selected Participant(s) cannot be contacted or he/she fails to answer all questions correctly, the Organisers reserve the rights to allocate the prize(s) to the next Selected Participant, chosen from the next random draw, and declare the said Selected Participant as a winner in accordance with the process described above.
17) Each Participant shall only win one (1) Prize throughout the Promotion Period, irrespective of the number of Eligible Entries collected by the Organisers. Participants who are declared as winners in a particular month will not be entitled for prizes in the months after or for the Promotion 2.
18) The winners will be contacted and notified by the Organisers by email and telephone call based on the information provided by their respective financial institutions within thirty (30) days after the monthly winners has been declared. The winners must respond of their agreement to accept the Prizes within seven (7) days of receiving the email notification or telephone call, as the case maybe.
19) All decisions made by the Organisers in relation to the Promotion including but not limited to the shortlisting, selection of winners and forfeiture of the Prizes shall be final, conclusive and binding. No correspondence, queries, appeals or protests will be entertained. The selection of the winners shall be subject to satisfactory fulfillment of the eligibility terms and entry criteria of the Promotion of which are determined at the Organisers’ absolute discretion.
20) The names of the winners shall be published and announced at the Organisers’ websites.

i) There will be four (4) draws to be performed throughout the Promotion Period. The draws will be conducted each month based on the Date of draw as mentioned on the above table. For Promotion 2, the draw will be conducted on the date mentioned above after the 3rd Draw for Promotion 1.
ii) Each Participant can only win one (1) prize throughout the Promotion Period, irrespective of the number of eligible entries received. Participant who are declared as winner in a particular month shall not be entitled for Prizes in the next following months and 2nd Promotion.
22) The Prizes are subject to the terms and conditions as stipulated in the prizes. To the fullest extent permitted by law, the Organisers and their agents exclude their responsibilities and all liabilities arising from any postponement, cancellation, delay or changes to the Prize details or any other unforeseen circumstances beyond the Organisers’ reasonable control and for any act or default of any third party suppliers or vendors. Winners are not allowed to exchange the Prizes for cash.
23) To the fullest extent permitted by applicable laws, the Organisers offer no warranty or representation whatsoever, express, implied or statutory, in relation to the Promotion, the Prizes including, but without limitation, the merchantable quality and fitness for purposes in respect of the Prizes and level of care and skill in respect of the relevant services provided in the Prizes.
24) The Organisers bears no liability in the event the winners are unable to utilise the Prizes for any reason whatsoever, including but not limited to reasons arising from breach of the terms stipulated by the By accepting the prizes, the winners hereby agree to participate in all publicity accompanying or resulting from the prize award.
25) All prizes are not transferable
26) The Organizer reserves the right to substitute a prize with another prize of similar value without prior notice.
 

Announcement or notification to winners

27) The winners will be contacted and notified by the Organisers based on the information provided by their respective financial institutions for Internet banking by email or telephone call within thirty (30) days from the end of the Promotion Period.
 

Prize Redemption

28) The winners must respond of their agreement to accept the Prizes within thirty (30) days from the date of receiving the email notification or telephone call. In the event of non-acceptance or failure to accept the Prizes within the required time, the Organisers reserve the right to disqualify the winner(s) and forfeit the Prize(s). All unclaimed Prizes will be forfeited and any enquiries thereafter will not be entertained. No refund will be given for any unclaimed Prizes.
29) Unless otherwise specified in the terms and conditions herein, no substitution or replacement of, or modification to the Prizes requested by Participants will be permitted.
30) In special situations and subject to the absolute discretion of the Organisers, a winner may nominate a designated representative to collect a prize. Written authorisation and identification for both winner(s) and their representative(s) will be required.
31) The winners are solely responsible for the claim and collection of the Prizes at a designated redemption venue determined by the Organisers. The Organisers shall not be liable and/or responsible for the transportation cost pertaining to the collection and/or delivery of the Prizes. All taxes, charges and incidental costs in this regard shall be solely borne by the winners.
32) The winners must complete and pass the verification process by the Organisers in order to redeem the Prizes in person. The Prizes will be forfeited if the winner(s) is unable to complete and pass the verification process successfully or if verification documents provided are in any way different from the information provided by the Financial Institutions. The required documents for verification are as follows:

 

(a) Winners’ original valid identity card (Malaysian) or original and valid passport (non-citizens); and
(b) A copy of online receipt issued by redONE for the Postpaid Bill Payment that displays the FPX Transaction ID and other details.

33) In the event that the required documents for verification and redemption are incomplete or not provided in a timely manner, the Organisers reserves the right to disqualify the winner(s) and the relevant Prize(s) declared will be forfeited. Winners may be required to complete and sign appropriate prize redemption agreement as requested by the Organisers.
34) In the event a winner chooses not to accept a Prize, which will be dealt with according to the absolute discretion of the Organisers subject to legislative requirements.
 
Liability and Responsibility
35) Winners shall assume full liability and responsibility in case of any accident, injury, damage, loss or claim resulting from participation of the Promotion, redemption and/or usage of the Prizes. The Organisers shall not be responsible for any liability, mishap, loss, damage, claim or accident (including death) suffered by third parties or the Participants in any manner whatsoever during and after the Promotion resulting from or arise out of the Promotion.
36) Participation in the Promotion and acceptance of the Prizes, the Participants and winners hereby grant to the Organisers to use the name, address, identification number, telephone number and photographs of the winners for purpose of advertisement and any other for publicity associated with the Promotion from time to time without any compensation or need for prior notification to the winners or participants. The Organisers shall not be responsible in any way whatsoever, in respect of technical failures of any kind, unauthorised human intervention or electronic/ human errors in the administration and processing of the Promotion.
37)

The Organisers, their promoters and agents shall not be liable in any manner whatsoever for the following :

 

a. Any additional expenses incurred by the participants for taking part in the Promotion;
b. Any sort of technical failure;
c. Intervention by unauthorised parties during the Promotion Period;
d. Electronic or human errors in the administration of the Promotion and processing of entries;
e. Any data entry that is lost, stolen, damaged, wrongly delivered or not received which is not due to the negligence or wilful default of the Organisers.

38) To the fullest extent permitted by the law, in no event will the Organisers or any of its officers, servants, employees, representatives and /or agents (including, any third party service providers that the Organisers may engage for purposes of the Promotion) be liable for any loss or damages (including loss of income, profits or goodwill or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Promotion, even if the Organisers have been advised on the possibility of such damages in advance, and all such damages are expressly excluded.
 

Data Protection

39) By participating in the Promotion and by submitting personal details with the Organisers, the Organisers agree to only collect it, use it for the purpose of the Promotion and protect them as set out below. This section also outlines the Participants’ rights regarding data protection, and tells the Participants how to contact the Organisers.
40) At times the Organisers may retain third parties to process the Participants’ personal data. All such third parties are contractually obliged not to use the Participants’ personal data in any way other than that which is specified herein.
41) Under the Malaysian law, the Participants’ rights include:
a) a right to withdraw consent to the use of personal data at any time by contacting the Organisers at the email address mentioned below providing the Organisers with the Participant’s name and email address for removal of the said personal data;
b) a right to obtain a copy of the personal data which the Organisers hold; and
c) a right to have incorrect personal data be corrected.
42) If the Participants wish to raise any data protection issue with the Organisers, or exercise any of their legal rights, please contact the Organisers at ebizfpx@myclear.org.my and finance@redone.com.my.
43) The Organisers take reasonable precautions to keep the Participant’s personal data secure, and require third party data processors to do the same. Please note, however, that the Organisers may release the Participant’s personal data if required to do so by law, or by search warrant, subpoena or court order.
44) The Organiser may transfer some personal information (name, address, contact numbers and NRIC numbers) to service provider(s) for the purpose of administering the Contest and contacting the winners. The service provider(s) include the vendor organizing or managing the Promotion.
 

Rights of the Organisers

45) The Organisers reserve the right to amend, change, remove or delete the Terms and Conditions herein at their sole and absolute discretion.
46) The Organisers shall not be liable to any Participant’s financial loss arising out of the refusal, cancellation or withdrawal of the Promotion.
47) The Organisers may assign all rights granted by a Participant hereunder to any party at the Organisers’ sole discretion.
48) The Organisers reserves the right to extend, cancel, terminate or suspend the Promotion for any reason whatsoever, without prior notice. Extension, cancellation, termination or suspension of the Promotion by the Organisers shall not entitle the Participant(s) to any claim or compensation against the Organisers for any loss or damage suffered or incurred as a direct and indirect result of the act of cancellation, termination or suspension.
49) By participating in the Promotion, each participant agrees that the Organisers use, publish or display the names and photographs of the winners for advertising and publicity purposes in any mode of publication, distribution or display without any royalty or compensation payable to the winners. Winners may also be required to attend and/or participate in publicity programmes. Representatives of the winners are not allowed.
 

General

50) Questions and enquiries about the Promotion are available by logging on to www.myclear.org.my or www.redONE.com.my at any time during Promotion Period.
51) The Terms and Conditions shall be governed and construed in accordance with laws of Malaysia and the exclusive jurisdiction of courts of Malaysia.
52) Time shall be of the essence of the Promotion.
